New Canadian Citizenship Rules (2025–2026): Many More People May Now Qualify

Canada has introduced major changes to the Citizenship Act, significantly expanding who can claim Canadian citizenship by descent. These changes took effect on December 15, 2025, and they may allow hundreds of thousands of people around the world to become Canadian citizens, including many who were previously excluded under older rules.

Why the Citizenship Law Changed
For many years, Canadian citizenship law contained what was called the “first-generation limit.”
This rule meant:
Canadian citizens born outside Canada could not pass their citizenship to their children if those children were also born outside Canada.
In practice, this prevented many families from passing citizenship to the second generation born abroad.
In December 2023, the Ontario Superior Court ruled that this limitation was unconstitutional because it unfairly excluded many Canadians and their descendants.
Following that decision, the Government of Canada passed Bill C-3, which amended the Citizenship Act and removed many of these restrictions. The new law came into force on December 15, 2025.
